Terms of Service: Fish & Chips

1. Agreement

These terms are the agreement between you and Fish & Chips (“we”, “us”) covering your use of the Fish & Chips app. By creating an account or using the app you accept them. If you do not accept them, please do not use the app. We may update these terms as the app changes or the law requires; the effective date above tells you when they last changed, and continuing to use the app after a change means you accept it.

2. Who can use the app

You must be 13 or over to create an account. You are responsible for keeping your login details secure and for anything done through your account. Tell us straight away if you think someone else has access to it.

3. Your account and your name

Choose a username and display name that are respectful, that you have the right to use, and that do not impersonate anyone else. We may rename or remove accounts using offensive, misleading, trademarked or impersonating names.

4. Content you add

You keep ownership of the photos, notes, lists, group names and other content you add. By adding it, you give us a non-exclusive, worldwide, royalty-free licence to store it and display it inside the app and — for shop photos you submit for publication — on the shop’s page and on our website. You can end that licence by deleting the content or your account, except where we have already used it somewhere that cannot reasonably be recalled.

You promise that content you upload is yours to upload. When you submit a shop photo, you confirm you took it or otherwise hold the rights to it. Do not upload photos taken from someone else’s website or social media.

5. Behaviour we do not allow — and what we do about it

There is no tolerance for objectionable content or abusive behaviour in this app. You must not post or send anything that is:

• illegal, or encourages anything illegal;
• abusive, hateful, harassing, threatening or discriminatory;
• sexually explicit, violent or otherwise obscene;
• defamatory, deceptive, or impersonating another person or business;
• spam, advertising, or a scheme to promote a business;
• someone else’s copyrighted work or private information.

Every shop photo is reviewed by a person before it is published, so nothing you submit reaches other users unchecked. If you see content or behaviour that breaks these rules, report it through the Feedback option on the Home screen or email hello@fishchips.org.uk. We aim to look at every report within 24 hours, and we remove content and suspend or delete accounts that break these rules — without warning where the breach is serious.

6. Check-ins and fair play

The app uses your device’s location to confirm you are within 200 metres of a shop, and you can check in to the same shop once per day. Do not fake, spoof or automate check-ins. Points, badges, ranks and challenge progress are a game: they have no monetary value, cannot be transferred or exchanged, and we may adjust or remove them where a check-in was faked, mistaken, or the result of a bug.

7. Tips and in-app purchases

The app is free. If you want to support it, you can leave a tip through the App Store or Google Play. Tips are one-off purchases that unlock nothing — no features, no badge, no content — and they are not donations to a registered charity. Apple and Google process the payment under their own terms; refunds are handled by them, not by us. Prices are shown in your local currency before you confirm.

8. Shop information

The shop directory is compiled from public sources, official registers, published awards and our own research. Listing is free and cannot be bought: no shop pays to appear, to rank, or to be featured, and we do not accept payment for placement. Star ratings shown against a shop come from third parties, such as Google and Tripadvisor, and belong to them.

We work hard to keep details right, but opening hours change, shops close, and menus move on. We cannot promise the information is complete or current, and we are not responsible for a wasted journey. If something is wrong — especially if you run the shop — tell us through the Feedback option and we will fix it. Shop owners can ask us to correct, or to remove, their listing.

9. Our content

The app’s design, code, text, badge artwork and the compiled directory are ours or our licensors’. You may use them through the app; you may not copy, scrape, resell or redistribute them, or use automated tools to extract the directory.

10. Availability

We provide the app “as is”. We aim to keep it running but cannot promise it will always be available, error-free, or compatible with every device, and we may change or withdraw features. Some functions need a working internet connection and location access.

11. Ending your use

You can stop at any time and delete your account in Settings. We may suspend or close an account that breaks these terms, abuses the community features, or games the check-in system. If we close your account, you lose access to your check-in history, points and badges.

12. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing here affects your statutory rights as a consumer. Beyond that, we are not liable for indirect or consequential loss, for lost data, or for anything arising from your visit to a shop listed in the app. Your visit is between you and that shop.

13. App store terms

You get the app through the App Store or Google Play, and their terms apply alongside these. This agreement is between you and us, not with Apple or Google: they have no obligation to provide support or to handle any claim about the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

14. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK, you may bring proceedings in your local courts.
